Online Bill Pay Agreement & Disclosure
These terms and conditions constitute the agreement ("Agreement") between you and Bank of Grand Lake with respect to the provision of Online Bill Payment Services (the "Service") to you. Your use of the Service constitutes your agreement to be bound by the terms of this Agreement and that your contract is with the Bank of Grand Lake, which is responsible to you for the provision of the Service. For clarity, the terms "we", "us", "our" and "Bank of Grand Lake" refer to the Bank of Grand Lake. In this Agreement the words "you" and "yours" mean each person who signed the application; the terms "us" and "we" mean the Bank of Grand Lake.
Bill Payment Service
By providing the Bank of Grand Lake with the names and account information of those persons or entities to whom you wish to direct payment, you authorize the Bank of Grand Lake to follow the payment instructions that it receives from you through the bill payment program. When the Bank of Grand Lake receives a payment instruction, you authorize the Bank of Grand Lake to charge your transaction account on the selected Process Date and remit funds to the designated payee on your behalf.
In the following instructions, the Process Date is defined as the day you request the Bank of Grand Lake to process the payment. A Business Day is defined as Monday through Friday up to 6:00 pm (Central Time) excluding weekends and holidays. All authorized payments will be processed and charged to your transaction account on the Business Day you select as the Process Date. The Payment will be mailed on the next Business Day.
If you select a Process Date that is a Saturday or a Sunday, the payment will be processed on the following Business Day. If the selected Process Date is a holiday, the payment will be processed on the following Business Day. Again, the payment will be mailed on the next Business Day.
For this reason, it is recommended that all Process Dates selected by you be at least five Business Days before the actual "payment due date", not the late date and/or grace period. If you properly follow the procedures described herein, and the Bank of Grand Lake fails to send a payment according to the payment instructions received, the Bank of Grand Lake will bear responsibility for all late charges. In any other event, including but not limited to choosing a Process Date which is not five business days before the due date or on or past the due date stated on your invoice, the risk of incurring and the responsibility for paying any and all late charges or penalties shall be borne by you.
Note: The Service may not be used to pay taxes or court-directed payments.
The Bank of Grand Lake will use its best efforts to make all your payments properly. If we do not complete a payment on time or in the correct amount according to the Agreement, we will be liable for your losses and damages. However, there are some exceptions to this liability. For instance, we will not be liable in the following circumstances:
- If through no fault of ours, you do not have enough funds in your account to make the transfer, or the transfer would exceed the credit limit on any overdraft line associated with the account;
- The equipment or software used by the Bank of Grand Lake to provide the Service was not working properly and you knew or were advised by the Bank of Grand Lake about the malfunction before you executed the transaction;
- You have not provided the Bank of Grand Lake with the correct names, addresses or account information for those persons or entities to whom you wish to direct payment:
- Circumstances beyond our control (such as but not limited to, fire, flood, or interference from an outside force) prevent the proper execution of the transaction despite the reasonable precautions we have taken;
- You have reported your Password as lost or stolen;
- Your Service has been canceled;
- If the funds in your account are unavailable because of garnishment, levy, or other hold requirements imposed upon us by law or by a government agency or court orders.
Password and Security
You agree not to give or make available your Online Password to any unauthorized individuals. If you believe that your password has been lost or stolen or that someone may attempt to use the Service without your consent or has transferred money without your permission, you must notify the Bank of Grand Lake at once.
Liability for Transactions
You are liable for all transactions made or authorized using your password. Do not, under any circumstances, disclose your password by telephone or to anyone claiming to represent the Bank of Grand Lake. Bank of Grand Lake employees do not need and should not ask for your password. Do not disclose your password to anyone. If despite the Bank of Grand Lake's advice, you give your password to anyone, you do so at your own risk. Anyone with access to your Internet Banking password or other means of account access will have full access to your accounts, even if you attempt to limit that person's authority. Should you believe your password has been compromised, please request that it be changed immediately. You must notify the Bank of Grand Lake that your password has been lost, stolen or otherwise compromised.
The Bank of Grand Lake is entitled to act on instructions received through Internet Banking under your password and without inquiring into the identity of the person using the password. Bank of Grand Lake has no responsibility for establishing the identity of any person using your password.
Errors and Questions
In case of errors and questions about your electronic transfers or payments, you should contact us as soon as you. If you think that your statement is wrong or you need more information about a transfer listed on the statement, you must notify us no later than sixty (60) days after you received the first statement on which the problem or error appeared.
Disclosure of Account Information to Third Parties
We will disclose information to third parties about your account or the transfers you make only in the following situations:
- Where it is necessary for completing transfers.
- In order to verify the existence and condition of your account to a third party, such as a credit bureau or merchant.
- To a consumer reporting agency for research purposes only.
- In order to comply with a governmental agency or court orders.
- If you give us your written permission.
Charges
Personal accounts at Bank of Grand Lake will enjoy making unlimited payments on Online Bill for free.
Business accounts can use Online Bill Pay and make up to 15 payments per month for only $ 9.95 and after that, each payment is only $0.70 each.
Documentation of Transfers
You will get a monthly account statement. However, with respect to a savings account, if there are no electronic funds transfers in a particular month, you may not get a statement monthly but you will get a statement at least quarterly.
Limitations on Transfers
Your ability to transfer funds between certain accounts is limited by federal law, as stated in the "Deposit Account Terms and Conditions." For example, you can make no more than six (6) transfers from a statement savings or money market deposit account per month and, in the case of a money market deposit account, no more than three (3) such transfers may be made by check. Fund transfers made using both Internet Banking Services and other transfer methods are counted against the permissible number of transfers. Transfers made in person are not subject to limitations.
Stopping Payment of Preauthorized Transfers From Your Account
If you have told us to make payments out of your account and you wish to stop any of these payments, telephone us before Noon (Central Time) on Business Day that the payment will be processed and we will attempt to stop the payment
In the Event You Have Insufficient Funds
In using the Service, you are requesting the Bank of Grand Lake to make payments for you from your Bank of Grand Lake account. If we are unable to complete the transaction (for example, there are not sufficient funds in your account to cover the transaction), the payment or transfer transaction may not be completed. In some cases, your account may be overdrawn and you will be charged NSF fees as agreed upon in your deposit account.
Alterations and Amendments
The terms of this Agreement, applicable fees, and service charges may be altered or amended by the Bank of Grand Lake from time to time. In such an event, the Bank of Grand Lake will post the amended terms or conditions on the Online BillPay page of this website. Any use of the Service after the Bank of Grand Lake posts this change will constitute your agreement to such change(s). Further, the Bank of Grand Lake may from time to time revise or update the programs, and/or related material which may render all such program versions obsolete. Consequently, the Bank of Grand Lake reserves the right to terminate this Agreement as to all such prior versions of the Service, and/or related material and limit access to the Bank of Grand Lake's more recent revisions and updates of the Service.
Termination or Discontinuation
In the event you wish to discontinue the Service, you must contact the Bank of Grand Lake in writing. Written notice of service discontinuance must be supplied ten (10) days prior to the actual discontinuation date and must be sent to:

The Bank of Grand Lake may terminate the use of the Service by any individual at any time. Neither termination nor discontinuation shall affect your liability or obligation under this Agreement.
Merchant or Payee Limitation
The Bank of Grand Lake reserves the right to refuse to pay any person or entity to whom you may direct a payment. The Bank of Grand Lake is obligated to notify you promptly if it decides to refuse to pay a person or entity designated by you. This notification is not required if you attempt to pay tax or court-related payments, which are prohibited under this Agreement.
Information Authorization
You agree that the Bank of Grand Lake reserves the right to obtain financial information regarding your account from a merchant, another payee or financial institution to resolve payment-posting problems.
Disputes
In the event of a dispute regarding the Service, you and the Bank of Grand Lake agree to resolve the dispute by looking to this Agreement. You agree that this Agreement is the complete and exclusive statement of the agreement between you and the Bank of Grand Lake which supersedes any prior agreement, oral or written, and any other communications between you and the Bank of Grand Lake relating to the subject matter of this Agreement except to the extent that this Agreement may be subsequently modified by the Bank of Grand Lake posting additional terms or modifications on the Web Site as described under the Alterations and Amendments section of this Agreement above. If there is a conflict between what a Bank of Grand Lake's employee says and the terms of this Agreement, the terms of this Agreement shall control.
No Waiver
The Bank of Grand Lake shall not be deemed to have waived any of its rights or remedies hereunder unless such waiver is in writing and signed by the Bank of Grand Lake. No delay or omission on the part of the Bank of Grand Lake in exercising any rights or remedies shall operate as a waiver of such rights or remedies or any other rights or remedies. A waiver on any one occasion shall not be construed as a bar or waiver of any right or remedies on future occasions.
Captions
The captions of Sections hereof are for convenience only and shall not control or affect the meaning or construction of any of the provisions for this Agreement.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflicts of laws provisions.
